
- The intending allottee(s) has applied vide applications dated..for allotment of a registration of a unit with full knowledge and subject to all the
laws/notification and rules applicable to the area in general which has been explained by the company and understood by me/us.
- As regards allotment of the plot of land I/We have satisfied myself/ourselves about the interest and the titles of the company on the said land, on which
the proposed unit will be constructed/plot is carved out and have understood all limitation and obligation in respect thereof. And I/We shall have no
objection in this regard upon the allotment.
- The allotment of a plot on the proposed scheme as far as possible be made to me/us within 24 months of my/our booking for the same.
- That the advance paid by me/us would be adjusted against the Booking amount payable by me/us and when your offer of booking of the Farm House
Plot / Bungalows Plot / Villa made to me/us.
- The timely payment of installment on due dates is the essence of this contract. It shall be incumbent on the intending allottee(s) to comply with the
terms of payment and other terms and conditions of sale, failing which the allotment of the intending allottee(s) shall stand cancelled and the booking
amount shall be forfeited. However, the company reserves its rights in its sole discretion to set aside the cancellation subject to payment of simple
interest, which shall not be less than 24%per annum on the amount of delayed payment.
- That earthsellers hitech homes Ltd. at all times reserves its rights to reject my/our application and cancel my/our Registration without assigning any
reason therefor and in such event I shall only be entitled to refund of the advance paid by me along with the simple interest @ 10% p.a. from the date of
payment made by me/us.
- That in case the company is not in a position to make offer of allotment for the Farm house plot / Bungalow plot / Villa Plot within a period of 15 months
from the date of my/our application for any reason whatsoever, we shall only be entitled to refund of the advances for provisional registration paid by us
along with simple interest @ 10 p.a. on such advance, subject to my/our giving you 30 days notice of the same.
- I/We agree if there should be any variation in the area of the Farm house plot / Bungalow plot / Villa Plot available at the time of Booking/Allotment then
in such case, the payment for the excess/shortfall in area shall be paid/refunded, as the case may be proportionately at same rate as agreed herein.**
- I/We understood the advance registration allotment of a Farm house plot / Bungalow plot / Villa Plot is subject to availability and the stipulation herein.
- EDC ( Extra Development Charges) and any enhancement there of by the Govt. shall be charged extra.
- PLC(s) (Preferred Location Choice) determined by the company shall be charged extra.
- Registration should be converted into booking upon payment of booking amount as calculated by the company within 15 days from the date of issue of the demand letter.
- Allotment shall be subject to due execution of the companys Agreement in its standard format including maintenance agreement and acceptance by me/us of all the terms and conditions of the company.
I/We also understand and agree that the company shall endeavour to give the possession of the Farm house plot / Bungalow plot / Villa Plot, I/We also
understand that the company will hand over the possession to me/us within 24 months from the date of initial booking to force majeure circumstances
and on receipt of all payment as per installment plan opted from the date of booking and on receipt of complete payment of the basic sale price and
other charges due and payable upto the date of possession according to the payment plan opted by me/us. The company on Completion shall issue
final call notice to the allottee(s), who shall within 45 days thereof, remit all dues and take possession of the Farm house plot / Bungalow plot / Villa. In
the event of failure to take possession for any reason whatsoever, I/We shall be deemed to have taken possession of the allotted Farm house plot /
Bungalow plot / Villa Plot and I/We shall bear all maintenance charges and any other levies on account of the allotted Farm house plot / Bungalow plot
/ Villa Plot.
The sale Deed shall be executed got registered in favour of the intending allottee(s) within a reasonable time after the completion of development work at the site and receipt of full price and other connected charges from me/us Cost of Stamp Duty and Registration/Mutation, documentation charges etc. as applicable will be extra and shall be borne by the intending allottee(s). The intending allottee(s) shall pay as and when demanded by the company. Stamp Duty and Plot, Registration Charges/ Mutation Charges and all other incidental and legal Expenses for execution and registration of sale.

Unless a conveyance deed is executed and registered, the company shall for all intent and purpose continue to be the owner of the land and this agreement shall give to the allottee(s) only the right and interest there in as allottee(s).
Mumbai Court alone shall have jurisdiction in all matters concerning this registration.
In case of any cheque issued by me is dishonored due to any reason, I will pay a penalty of Rs 2000/-
I here by agree that if I cancel the booking of the farm house plot/Bunglow/ villa booked by me, At any point of time within the payment schedule period, I Shall get the payment after 10% deduction on the basic selling price and I shall have to pay 24% interest on all the late payments till that date.
The amount after deducting 10% cancellation charges of BSP and 24% interest on late payments, shall be given to me within 90 days of the
written cancellation notice given by me to the company.

by you to the above address shall be valid intimation to me/us regarding the contents there in. In case my/our application for Registration is accepted
and the company makes offer of booking then I/We under take to execute all documents/agreement as per the companys format and accept all the
terms and conditions therein.
